GENERAL TERMS AND CONDITIONS OF SALE

Clause 1 : Purpose and Scope
These General Terms and Conditions of Sale (“GTCS”) form the basis of the contractual relationship between Joaillerie Recrutement and its clients.
They apply to all recruitment-related matchmaking services provided by Joaillerie Recrutement and are made available or accessible to the client prior to any order.
Acceptance of a quotation, order form, or contract, including via electronic signature, constitutes full and unconditional acceptance of these GTCS.

Clause 2 : Pricing
Service prices are stated in euros, excluding VAT, and are those in effect at the time of the order. Applicable VAT will be added at the legal rate in force on the date of invoicing.
Joaillerie Recrutement reserves the right to revise its prices at any time. However, the services will be billed at the rates in effect at the time the order is recorded.

Clause 3 : Discounts and Rebates
Prices may include any applicable discounts or rebates previously agreed upon between the client and Joaillerie Recrutement.

Clause 4 : Early Payment Discount
No discount will be granted for early payment.

Clause 5 : Payment Terms
Payments may be made by:

bank transfer,

credit card,
-
or cheque.
Payment terms are as follows:

50% due within 8 days following the candidate’s start date,

balance due within 8 days following confirmation of the probation period.

Clause 6 : Late Payment
In the event of full or partial late payment, a late payment penalty equal to three (3) times the legal interest rate in effect on the contract date will automatically apply, without the need for prior notice.
In accordance with Articles 441-10 and D. 441-5 of the French Commercial Code, a fixed recovery charge of €40 will also be payable for collection costs.
Clause 7 : Liability
Joaillerie Recrutement acts strictly as an intermediary. It is the client’s sole responsibility to comply with all legal obligations as an employer, including social declarations and the payment of wages and related charges.
Joaillerie Recrutement shall not be held liable, under any circumstances, for employment relationships or obligations established between the client and the recruited candidate.

Clause 8 : Confidentiality
Joaillerie Recrutement undertakes to maintain strict confidentiality regarding all information shared by the client. No confidential or strategic data shall be disclosed to third parties without prior written consent.

Clause 9 : Personal Data (GDPR)
In the context of delivering its services, Joaillerie Recrutement may collect and process personal data concerning the client or its representatives.
Such data is processed in accordance with our Privacy Policy, which the client acknowledges having read and accepted.
The client may exercise their rights (access, rectification, objection, etc.) under the GDPR as set out in said policy.

Clause 10 : Recruitment and Moderation Charter
The client acknowledges having read and accepted the Recruitment and Moderation Charter, which forms an integral part of these GTCS. The client agrees to uphold its principles throughout the business relationship.

Clause 11 : Intellectual Property
All candidate profiles, documents, presentations, and materials shared by Joaillerie Recrutement are confidential and intended solely for use by the client for the relevant recruitment purpose.
Any reproduction, distribution, or unauthorized use constitutes infringement and may give rise to legal proceedings.

Clause 12 : Jurisdiction and Applicable Law
These GTCS are governed by French law.
In the event of a dispute and failing amicable resolution, the Commercial Court of Paris shall have exclusive jurisdiction.
