The terms "we," "our," "the company," or "Joaillerie Recrutement" refer to JOAILLERIE RECRUTEMENT SAS, 21 rue de Civry, 75016 Paris.

If you do not agree to all the terms of this Agreement and refuse to be bound by them, please do not use the Service.

You must be up-to-date with your subscription payment.

You agree to comply with these Terms and Conditions of Use and all applicable local, state, national, and international laws, rules, and regulations, and you will respect the rights of third parties.

3.Access to the Service

The client of the Joaillerie Recrutement website and the App Jewellery Recruitment (Website and Application) has access to the following services depending on the specific terms of their contract:

Subscriptions to the App Jewellery Recruitment offering different levels of services to candidates, interns, apprentices, and freelancers in the jewelry industry.

4.Your Account

To use the App Jewellery Recruitment (Website and Application), you must log in using your username (email address) and password.

Your username and password are personal and non-transferable and can be modified if necessary.

You are responsible for maintaining the confidentiality of the login credentials you use to register on the App Jewellery Recruitment (Website and Application) and are solely responsible for all activities that occur under these credentials. You guarantee:

Not allowing any third party to use your Member Space on your behalf or for your account;
Taking all appropriate measures to ensure the security and confidentiality of your password and username.

The direct or indirect consequences resulting from a delayed notification or failure to notify us in case of loss or theft of your credentials and password are your full responsibility.

5.Modification of the Service and Termination

Joaillerie Recrutement SAS strives to continuously improve the Service and provide additional features that you may find useful and interesting. This means that we may add new product functions or improvements at any time, and we may also remove certain features. In the event that such actions do not materially affect your rights or obligations, we may not notify you prior to implementing them. We may even suspend the entire Service, in which case we will notify you in advance unless extenuating circumstances, such as security or safety issues, prevent us from doing so.

The easiest way to terminate your account is to request it by email at contact@joaillerierecrutement.com. If you decide to terminate your account before its term, you will not be entitled to a refund for your purchases or subscription.

Joaillerie Recrutement SAS may close your account at any time and without notice if we believe that you have violated this Agreement. After such termination, you will not be entitled to a refund for your purchases or subscription.

6.Community Rules

By using the Service, you agree to refrain from the following, without this list being considered exhaustive:

Using the Service for any illegal or prohibited purpose under this Agreement, or for purposes contrary to these Terms and Conditions of Use.
Using the Service for malicious or fraudulent purposes.
Using the Service to harm Joaillerie Recrutement SAS and disrupt or interfere with the functioning of Joaillerie Recrutement SAS.
Sending unsolicited mail, requesting money from members, or scamming them.
Distributing personal information of another person without their consent, downloading, reproducing, storing, copying, compiling, decompiling, sharing with a third party, or exploiting by any means the content of the App Jewellery Recruitment (Website and Application) and/or the results of its use.
Using another member's account, sharing an account with another member, or owning more than one account.
Disrupting the functioning of the Services or imposing an undue burden on them (spam, denial of service attacks, viruses, game algorithms).
Violating the intellectual property rights or other rights of Joaillerie Recrutement SAS.
Attempting to mislead other users or third parties by impersonating the name or business of others.
Posting, distributing, or using on or from the App Jewellery Recruitment (Website and Application) content that infringes the rights of third parties, including intellectual property rights, personal rights, privacy, public order, good morals, and generally applicable laws and standards for business practices, politeness, and courtesy.

Joaillerie Recrutement SAS reserves the right to investigate and/or close your account without refunding your purchases if you have violated this Agreement, misused the Service, or engaged in behavior that Joaillerie Recrutement SAS deems inappropriate or illegal, including actions or communications occurring outside the Service. Additionally, in certain circumstances, we may close your account for failure to comply with the applicable conditions of Joaillerie Recrutement SAS. If you fail to adhere to these rules or our Community Rules, your authorization to use the Service will be automatically revoked.

7.Obligations of Joaillerie Recrutement SAS

Joaillerie Recrutement SAS provides access to certain information through the App Jewellery Recruitment (Website and Application).

It is the responsibility of users to ensure they have the appropriate technical means to access and use our Services.

Joaillerie Recrutement SAS will ensure the security of access to and use of the App Jewellery Recruitment (Website and Application), which is generally accessible 24/7, except in cases of force majeure or events beyond the control of Joaillerie Recrutement SAS, and subject to potential technical failures, malicious acts, or damage to the hardware.

For direct and/or indirect damages that could result from using content, data, or information of any kind accessed via hyperlinks on the Website leading to third-party sites. It is your responsibility to check that the information on these partner websites is accurate, complete, and complies with regulations. It is also reminded that these Terms and Conditions do not extend to third-party websites;
For elements outside of our control and damages that may result in your technical environment, including your computers, software, network equipment, and any other hardware used to access or use our Website and Services;
For any loss or alteration of data, loss of profits, revenue, opportunities, time, or any indirect damages, whether due to negligence or any other cause, related to the execution or non-execution of these Terms and Conditions.

8.Content of Other Members

Although Joaillerie Recrutement SAS reserves the right to review and remove any content that violates this Agreement, it cannot guarantee that all content will comply with these Terms and Conditions. 9.Subscription

You can subscribe to the services of the App Jewellery Recruitment (Website and Application) by completing the online registration form.

Subscribing to a service on the App Jewellery Recruitment (Website and Application) and to the services of Joaillerie Recrutement SAS allows the user to access the platform's content for reading and/or temporary downloading.

A)Duration and Types of Subscription

We offer different types of annual subscriptions:

BASIC Subscription: Provides access to the entire database of qualified and anonymous candidates of Joaillerie Recrutement SAS without filters + Interns and Apprentices + Freelancers.

SELECTION Subscription: Provides access to the entire database of qualified and anonymous candidates of Joaillerie Recrutement SAS with filters on 1 profile: 1 position and 1 geographical area + Interns and Apprentices + Freelancers.

ALERT Subscription: Provides access to the entire database of qualified and anonymous candidates of Joaillerie Recrutement SAS for 2 profiles: position + geographical area

+ notifications + Interns and Apprentices + Freelancers.

TOP Subscription: Provides access to the entire database of qualified and anonymous candidates with all filters + notifications + offline profile for 48h + immediate appointment request + access to VIP candidates + Interns and Apprentices + Freelancers.

All subscription types provide unlimited access to the App Jewellery Recruitment (Website and Application) and the services of Joaillerie Recrutement SAS.

Upon registration, you must specify the type of subscription you wish to purchase. You can subscribe to all our subscription types for a minimum commitment period of one year, which will be automatically renewed for an equivalent period unless you request cancellation according to the termination clause outlined below.

B)Right of Withdrawal

If you subscribe to the subscription through the Joaillerie Recrutement SAS website, you have the right to withdraw without giving any reason within 14 days from the date of your registration, by postal mail to the following address: 21 rue de Civry 75016 Paris, using the following withdrawal form:

Withdrawal is only possible within 14 days following your remote registration (on our website).

Mandatory signature (on paper).

If the 14th day falls on a weekend or holiday, the right of withdrawal expires at the end of the first business day following.

If you decide to exercise your right of withdrawal and the subscription has not been used during this 14-day period, this cancellation is free of charge. If the subscription has been used during the 14-day period, Joaillerie Recrutement SAS may reserve the right to retain part of the subscription amount on a pro-rata basis (from the activation of the subscription until the day of cancellation, including any registration fees). You will be refunded as soon as possible, and at the latest within 14 days after receiving your cancellation request for the Subscription, using the same payment method originally chosen.

C)Payment of Subscriptions:

You pay in advance in one lump sum for the agreed contractual period using STRIPE or other external services authorized by Joaillerie Recrutement SAS. Joaillerie Recrutement SAS may

also offer products and services for purchase by credit card or other payment methods on the Website or in the APDJ application.

If for any reason we fail to receive your payment, we will remind you by email and/or registered mail with acknowledgment of receipt. If after this reminder, you still fail to meet your payment obligation, your subscription will be blocked until you comply with your payment obligation.

If after being put on notice, you still fail to meet your payment obligation, you will be considered in default. We may then terminate the Contract immediately. You will then owe all subscription fees that should have been paid during the Contract term, plus collection fees.

If after being put on notice, you still fail to meet your payment obligation, you will be considered in default. We may then terminate the contract with immediate effect. You will then owe all subscription fees that should have been paid during the term of the contract, plus collection fees.

Subscriptions to Joaillerie Recrutement SAS grant you access to the Joaillerie Recrutement SAS database. Therefore, if you do not use the contract, there will be no refund.

Similarly, if you decide to cancel the subscription before its term, there will be no refund.

Prices are listed excluding taxes. Joaillerie Recrutement SAS reserves the right to apply any new tax, VAT, or VAT rate increase as soon as they come into effect.

Subject to the User's right to cancel their subscription under the conditions described below, Joaillerie Recrutement SAS reserves the right to change the subscription price at any time. Any increase in Value Added Tax (VAT) or the introduction of any new tax applicable to the service may also be reflected in the service price.

Joaillerie Recrutement SAS will notify each User via the Application or by email of any subscription price increase at least 30 (thirty) days before it takes effect. Any User may cancel their subscription up to twenty-four (24) hours before the new price comes into effect.

D)Cancellation

You can cancel your contract before its expiration by providing a 2-month notice. You can cancel your contract by one of the following methods:

Once the subscription is properly canceled, the client will no longer have access to the content of the Joaillerie Recrutement SAS database.

The User acknowledges that Joaillerie Recrutement SAS has the right to suspend access to the APDJ Application, to terminate the subscription automatically, without notice or compensation, without prejudice to any damages Joaillerie Recrutement SAS may claim, if it has valid reasons to believe that the User has violated or acted contrary to the contract or to the business interests of Joaillerie Recrutement SAS, including in cases of:

The User providing false information during the subscription to a service;

Any delay or failure to pay, in whole or in part, a subscription;
Any fraudulent use of the User’s account, including but not limited to:

Failure by the User to respect any intellectual property rights (including any intellectual property elements) of Joaillerie Recrutement SAS and/or its rights holders;
Bypassing or attempting to bypass technical protection measures for the content;
Sharing the User’s credentials with any third party to allow them to benefit from the subscription;
Multiple simultaneous connections or attempts to make multiple simultaneous connections to a single User account.

Any judicial requisition or court order with enforceable force.

In the case of a violation of current legislation or infringement of third-party rights by the User, Joaillerie Recrutement SAS also reserves the right to provide, at the request of any legitimate judicial or administrative authority, the information necessary to identify the User.

10.Purchases

At any time, Joaillerie Recrutement SAS may offer products and services for purchase (“in-app purchases”) via the App Store, Google Play Store, mobile operator, direct billing by Joaillerie Recrutement SAS, or other payment platforms authorized by Joaillerie Recrutement SAS. If you choose to make an in-app purchase, you will need to confirm the purchase through the applicable payment provider, and your payment method (whether it’s a credit card or a third-party account like Google Play or the App Store) will be charged for the in-app purchase, including the displayed price for the selected service(s) and any sales tax or other charges that may be imposed on your payments. You authorize Joaillerie Recrutement SAS or the third-party payment account, as applicable, to charge you.

11.Limitation of Liability

Joaillerie Recrutement SAS is only required to use reasonable efforts regarding accessibility to the Joaillerie Recrutement SAS service and the App Jewellery Recruitment (Website and Application).

The use of the App Jewellery Recruitment (Website and Application) is at the sole responsibility of the User, especially in cases of fraudulent use of the Application or the User’s Account by the User or any third party resulting from the User’s error, carelessness, or negligence (including any communication by the User of their credentials).

The User acknowledges and accepts that the internet network, and more generally, any telematics network used for data transmission, may carry risks due to the lack of protection for certain data against potential hijacking or contamination by viruses.

Therefore, Joaillerie Recrutement SAS cannot be held responsible for any loss or alteration of data, loss of profit, revenue, opportunities, time, or any indirect damage, in the case of technical access issues, temporary or permanent unavailability of the App Jewellery Recruitment (Website and Application), caused by the User’s failure to meet the contract, issues related to the User’s hardware, internet network, unforeseen and insurmountable events from third parties, or force majeure as defined by Article 1218 of the Civil Code.

Furthermore, Joaillerie Recrutement SAS disclaims any responsibility for fraudulent use of the Content that may take place without its knowledge in violation of the contract, including any illegal access, distribution, or download of the Content.

The information provided through the App Jewellery Recruitment (Website and Application) is purely indicative. The User is encouraged to verify the information provided or made accessible by the Application.

The content available within the App Jewellery Recruitment (Website and Application) only engages the responsibility of its creators and/or authors.

Under no circumstances will Joaillerie Recrutement SAS be held responsible for indirect damages, especially in cases of direct or indirect loss of profit, data loss, or other losses arising from your access to, use of, or inability to access or use the service; the conduct or content of other members or third parties on the services, through them, or following their use; or unauthorized access, use, or alteration of your content, even if Joaillerie Recrutement SAS has been informed of the possibility of such damages.

Under no circumstances will Joaillerie Recrutement SAS be held responsible for complaints related to the service in an amount greater than what the user has paid.

Certain jurisdictions may not allow the exclusion or limitation of certain damages, and therefore, some exclusions or limitations may not apply to you.

12.Personal Data

Joaillerie Recrutement SAS is the data controller for personal data processed through the Joaillerie Recrutement SAS application and, as such, commits to comply with Law No. 78-17 of January 6, 1978 (the “Data Protection Act”), as amended, and the General Data Protection Regulation (GDPR). For certain processing of personal data related to the User, Joaillerie Recrutement SAS may be considered a data processor under the GDPR.

In accordance with the “Data Protection Act” and the “GDPR”, any individual whose personal data is processed by Joaillerie Recrutement SAS has the right to access, oppose, rectify, erase, or delete part or all of their personal data, as well as the right to limit processing and data portability, which can be exercised by writing to: contact@joaillerierecrutement.com.

13.Intellectual Property

The App Jewellery Recruitment application is a work protected by applicable legislation, including Articles L. 122-1 and subsequent of the Intellectual Property Code, operated by Joaillerie Recrutement SAS. Texts, photographs, animated or non-animated images, know-how, designs, graphics, and all other elements comprising it, and the website hosting it, are the property of Joaillerie Recrutement SAS or third parties who have authorized Joaillerie Recrutement SAS to use them.

Any total or partial reproduction of the App Jewellery Recruitment application and any use or extraction of any kind (including scraping) is prohibited, unless expressly authorized in writing by Joaillerie Recrutement SAS.

Any unauthorized use constitutes infringement under Articles L. 335-2 and subsequent of the Intellectual Property Code, and may result in civil and/or criminal prosecution.

14.Applicable Law

Both the website and the terms and conditions of its use are governed by French law, regardless of the place of use.

In case of any dispute, and after failing to find an amicable solution, any litigation between the parties concerning the signing, interpretation, execution, and termination of these terms will be brought before the French courts, to which the parties expressly assign jurisdiction, even in the case of multiple defendants, interim proceedings, or guarantee claims.

15.Entire Agreement

This agreement, including the Privacy Policy and all the conditions disclosed and accepted by you when purchasing any additional features, products, or services we offer on the Service, contains the entire agreement between you and Joaillerie Recrutement SAS concerning the use of the Service. If any provision of this Agreement is found to be invalid, illegal, unenforceable, or inapplicable, the remainder of this Agreement will remain in full force and effect. Failure by the Company to exercise or enforce any provision of this Agreement shall not constitute a waiver of such.
